Terms & Conditions
By booking through Anywhere Tour Co., Ltd. ("Anywhere.Tours"), you agree to these legally binding terms. Please read them carefully.
1. Bookings & Payments
- Voucher & Timing: Upon successful payment, a voucher is generated immediately. The printed time is the general tour start time, not your pickup time. Anywhere.Tours will separately confirm your exact hotel pickup window one day before your tour date.
- Content Accuracy: Anywhere.Tours reserves the right to correct typographical or pricing errors on the website. If a system error occurs, we reserve the right to cancel the booking and issue a full refund immediately.
- Third-Party Cards & Fraud Prevention: The booking name must match the credit card billing name. At check-in, we and our operators reserve the right to verify the physical credit card and matching Passport. For third-party cards, you must present a copy of the cardholder's passport, the physical card, and a signed authorization letter. Failure to comply results in immediate tour denial with a 100% fraud penalty and zero refund.
- Child Rates & Infant Policy: Child rates are subject to age/height rules on product pages. If exceeded, the adult price difference must be paid at the pier, or the booking is canceled without refund. Infants under the age limit join free; however, no complimentary car seats, infant-sized life jackets, or meals are provided. Infants must sit on an adult's lap. No complaints regarding infant facilities will be accepted.
- PDPA Consent: You explicitly authorize Anywhere.Tours to process your personal data (passport details, names, contact channels) and transfer it to third-party operators and marine insurance providers strictly for tour manifests and mandatory accident insurance registration.
2. Cancellations & Amendments
- Standard Timeline: Unless specified otherwise on individual product pages, our default policy is:
- More than 24 hours before departure: Eligible for a Full Refund.
- Less than 24 hours before departure / No-Show: Subject to a 100% penalty of the total booking value (including tour, transfers, and add-ons) with zero refund.
- Strict Rescheduling: Requests to change or reschedule a tour date made less than 24 hours before departure are strictly prohibited and treated as a No-Show (100% penalty/zero refund).
- Medical & Sick Policy: Missed tours due to sudden illness require a formal medical certificate issued strictly by a registered, fully accredited international or government hospital (clinic certificates are not accepted). Approved waivers are at the operator's final discretion and apply only to the specific sick individual. Companions must proceed as scheduled or face a No-Show penalty.
- Transit Delays: Cancellations or missed tours due to flight delays, airline cancellations, or cruise ship schedule changes are 100% non-refundable. Travelers must claim these losses through their personal travel insurance.
3. Weather & Itinerary Adjustments
- Official Warnings Only: Full refunds or reschedules are only issued if the Thai Meteorological or Marine Department issues an official warning prohibiting boat operations and the operator cancels the trip.
- Rain Policy: If it is raining but no official restriction is issued and the vessel is cleared to sail safely, the tour proceeds normally. Cancellations due to personal dislike of rain, cloudy skies, or mild waves are 100% non-refundable.
- Route Adjustments & National Parks: Operators reserve the right to modify daily programs, routes, or activity sequences without notice due to sea tides, traffic, safety concerns, or sudden government island closures (e.g., Maya Bay, Similan Islands). No partial refunds or discounts apply if alternative locations are provided.
- Unused Services & Food: No partial refunds apply if a customer voluntarily skips parts of the program (snorkeling, land stops) or leaves early. Package meals/buffets missed due to personal delays or personal dislike are entirely non-compensable.
- Guide Language: Tours are conducted by local licensed English-speaking guides. Language proficiency and accents follow local industry standards and cannot be used as grounds for disputes or refunds.
4. Chargeback Disputes
- Processing: Approved refunds are reversed immediately. Card processing (Stripe) takes a few business days depending on your bank; PayPal follows standard account settlement timelines.
- No-Chargeback Agreement: By booking, you explicitly waive the right to file an online credit card dispute or bank chargeback for shared transfer delays, rainy weather where boats sail safely, personal illness/sea-sickness, oversleeping, wrong hotel details, tour guide language proficiency, third-party card verification issues, or being denied entry for safety, dress code, environmental, or unpaid fee violations.
- Fraud Recovery: Fraudulent or ungrounded chargebacks will be reported to credit bureaus. Anywhere.Tours reserves the right to legally recover bank penalty fees, administration costs, and legal expenses within the Kingdom of Thailand.
5. Health, Safety & Equipment Rules
- Pregnancy Restriction: Pregnant women are strictly prohibited from all sea tours, speedboats, and adventure activities. Entry will be denied at check-in with zero refund.
- Medical Advice & Sea-Sickness: Seniors, infants, or persons suffering from mobility limitations, heart conditions, or severe allergies must consult a doctor before booking and declare conditions at checkout. Sea-sickness is treated as a personal physical condition; basic motion sickness pills are provided, but no medical claims or refunds can be demanded.
- Physical & Weight Limitations: Compliance with weight criteria or physical restrictions stated on product pages (e.g., ziplines, helicopters) is mandatory. If denied entry due to weight breaches, no refund will be issued.
6. Insurance & Property Exclusions
- Same-Day Hospital Rule: To qualify for mandatory local accident insurance under Thai law, an injured guest must seek hospital treatment on the exact day of the accident, coordinated directly by our tour team.
- Mandatory Operator Insurance: You must use the medical insurance policy provided by the tour operator for initial hospital registration. If you refuse it or choose to use your personal insurance instead, you permanently waive all subsequent claim or compensation rights against us or the operator.
- Luggage and Restricted Items: Standard tours only accommodate small daypacks. Large suitcases, heavy luggage, unpermitted drones, weapons, and flammable cargo are strictly prohibited inside transfer vans and speedboats.
- Property & Rental Gear Damage: Insurance covers bodily injury only; it never covers lost, stolen, or damaged personal property (phones, cameras, cash, drones). Customers are fully liable for any damage or loss caused to rental gear provided (snorkeling masks, life jackets, fins, kayaks) and must pay for replacement costs directly to the operator before leaving the pier.
7. Hotel Pickups & Transfers
- Location Accuracy: You are solely responsible for providing the correct hotel name, address, and room number. Unannounced hotel changes or wrong details resulting in a missed van are treated as a late No-Show (zero refund).
- Extra Transfer Charges: Remote hotel locations outside our standard complimentary zones are subject to an additional remote area transfer charge. It is the customer's responsibility to read and understand these zone fees before booking. If you refuse to pay the mandated extra transfer fee upon the driver's arrival, the operator reserves the right to deny you entry onto the transport vehicle/tour with zero refund.
- Contact Channel & Delays: Customers must provide a valid, working contact method (such as an active WhatsApp) accessible on the morning of the tour. Shared transfers pick up from multiple hotels; please expect operational delays of 15–30 minutes or more due to traffic or other guests. No refunds apply to transfer delays.
- Self-Arriving Guests: Self-arriving guests must meet directly at the pier/meeting point on time. To prevent credit card fraud, all self-arriving guests must present their original Passport and sign a physical verification manifest at the pier counter before boarding. Refusal results in an immediate tour block with zero refund.
8. Code of Conduct & Right of Refusal
Anywhere.Tours and its operators reserve the absolute right to remove a guest or refuse tour continuation with zero refund and charge 100% of private return transfer costs to the customer if they violate any of the following:
- Behavior & Intoxication: Engaging in disruptive, abusive, or dangerous behavior toward staff or other travelers, or showing clear signs of severe alcohol intoxication or drug impairment at pickup or check-in.
- Substances: Possessing, consuming, or smoking illegal drugs, narcotics, cannabis/weed, including THC edibles and cannabis-infused products, while inside tour vehicles, vessels, or premises.
- Marine & Environmental Protection Rules: Under strict laws of the Kingdom of Thailand, customers are prohibited from touching, collecting, or damaging coral reefs, feeding marine life, or catching wild animals. Any legal fines, government penalties, or criminal prosecutions resulting from a customer's violation of environmental laws shall be borne 100% solely by the customer.
- Violations of Specified Fees & Dress Codes: Failing to dress respectfully for religious site visits, or refusing to pay required cash National Park fees or remote zone transfer charges upon arrival.
- Review Extortion and Defamation: Using threats of negative online reviews (Google, Tripadvisor, OTAs) or social media defamation to extort cash refunds, discounts, or compensations that violate these terms is strictly prohibited. Anywhere.Tours reserves the right to seek full financial damages under Thailand's Computer Crime Act and defamation laws against individuals engaging in review blackmail.
- Animal Welfare: Some excursions operate as shared group tours that may stop at transit points where working animals (elephants/monkeys) are present. Animals have been traditionally domesticated in Thailand for centuries (similar to horses in Western countries). Anywhere.Tours has zero tolerance for active abuse, but no refunds/disputes apply based on the standard presence of traditional working animals during shared transits.
9. Media Release
By joining our tours, you authorize staff or photographers to take photos/videos of you. Anywhere.Tours reserves the right to use these materials for marketing, websites, or social media royalty-free, without prior approval.
10. Liability Disclaimer
- Third-Party Disclaimer: Anywhere.Tours acts as an agent connecting customers with licensed local tour operators. Anywhere.Tours shall not be held liable for any personal injury, property damage, loss, delay, or irregularity caused by the acts, omissions, or defaults of any third-party transportation provider, boat operator, or activity host.
- Limitation of Financial Liability: To the maximum extent permitted by law, the total collective financial liability of Anywhere.Tours, its directors, or employees for any proven claim or operational negligence shall be strictly limited to the total amount paid by the customer for the specific booking in question. We accept no liability under any circumstances for indirect, consequential, or emotional damages.
11. Governing Law
These terms are governed by the laws of the Kingdom of Thailand. All legal disputes fall under the exclusive jurisdiction of the Thai courts.
